A Whitewater councilman was forced to step down from his elected seat after being convicted Friday on drug charges.

District 2 Councilman Javonni Butler, 22, plead guilty Friday to a felony charge of delivering marijuana as part of a plea agreement.

Butler was sentenced to 45 days in jail and two years on probation as part of his plea agreement.

According to the Government Accountability Board, anyone convicted of a felony cannot hold office.

Butler, elected last spring, was forced to resign Friday immediately after the guilty plea.

According to the criminal complaint, Butler sold marijuana to a police informant wearing a wire on March 16 and 18 at his UW-Whitewater apartment.

City Council President Patrick Singer said the council hopes to fill the vacant seat before the end of November.

According to Singer, the council will advertise the open seat in local newspapers and on the city website, asking those interested to submit a letter of interest.

Singer said the vote will occur in an open session where candidates will be allowed to speak and answer questions from the council.  At that time, the council will vote on a new councilman.

Anyone who is an eligible voter in District 2 is welcome to apply for the position, Singer said.

The appointed councilman will hold the seat until April 2012 when the seat will be up for election again for a full two-year term.
